AGREEMENT Overview: This contract is put into place so you will know exactly what a session with me consists of and to ensure that I am able to deliver up to your expectations.  Please read all information carefully. You must sign & return this form as well as the model release form the day of your photo session, or I cannot proceed any further.  If you have any questions, please contact me before your session.  I am looking forward to working with you. 


1. Booking: Please note that $20 is due at the time of your booking for a regular and newborn session, and $10 is due for a mini session,  This is a NON- REFUNDABLE RETAINER. In the event of cancellation, the retainer paid is non-refundable. It shall be liquidated for damages to Simply Me Photography in the event of a cancellation, or breach of contract by the CLIENT. The CLIENT shall also be responsible for payment of any materials/charges incurred up to time of cancellation. The retainer shall be applied towards the total cost of the service to be rendered. The remaining charges are payable in full on the date of the session. Simply Me Photography considers a session booked only upon receipt of both payment and this signed contract. It reserves the right to book other clients for the desired session until both items are received. Rates are subject to change without notice. Clients will receive rates posted at time of booking.


2. Cooperation: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Simply Me Photography is not responsible if key individuals fail to appear or cooperate during photography sessions or for missed images due to details not revealed to Simply Me Photography.


3. Rescheduling/Late Arrivals: In the event that clients wish to reschedule a session, all amounts paid are NON-REFUNDABLE, but will be put towards another session IF proper notice was given. In the event of postponement, notice must be given at least 24 hours  prior to the scheduled time and must be rescheduled within same calendar year. If you arrive more than 15 minutes late for your session, I will ask you to reschedule, no matter how long the distance. Please be on time.


4. Limit of liability: In the unlikely event that the photographer is injured or becomes too ill, or has an extreme emergency that prevents her from photographing the event or session, Simply Me Photography will make every effort to reschedule the event. If for whatever reason this is not possible, responsibility and liability is limited to the return of all payments received for the package purchased. Simply Me Photography takes the utmost care with respect to exposure, transportation, processing and archiving the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Simply Me Photography's control, Simply Me Photography’s liability is limited to the return of all payments received for the portrait package. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client's order.


5. Physical Liability: Clients are responsible for their conduct at all times. Any breakage or damage to equipment or studio contents are the sole financial responsibility of clients. Clients agree to hold Simply Me Photography and its agents harmless for any injuries or damages sustained preceding, during, and immediately following a session. In the event the Client’s behavior becomes abusive to Lori or a member of her staff, Client will be asked to leave, session canceled and all payments forfeited to Simply Me Photography.


6. Images and Copyright: The photographs produced by Simply Me Photography are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without Simply Me Photography's written permission. Commercial use of images is strictly prohibited. Images may not be entered into any contest or submission without prior written authorization.  Screen grab downloads, printing of digital images and scanning of prints for digital imagery use is illegal and punishable by law. If you purchase digital images which are provided to Clients on a CD or a USB, they must have a link to my Facebook page, or my website, if they do not have my watermark on them.


7. Payment: Simply Me Photography accepts cash payments with a receipt as proof as payment, as well as Paypal. If paying via Paypal, please submit payment to: simplymephotographybylori@gmail.com


8. Illness: I would never want to photograph someone who isn't feeling 100%.  If someone becomes ill, please contact me ASAP to reschedule.  Please text or call (608) 387-0860, rather than leave me a message on Facebook.  I don't always check Facebook before I leave for a session.


9. Bringing other persons:  Because it can be distracting (especially to small children) and prevents me from doing my very best work, other cameras are NOT allowed at photo sessions.  Also, please only bring the people that will be photographed to your session.  Too many people around creates too much of a distraction. I need your child's focus to be on me in order to get the best images.

In exchange for consideration received, I hereby give permission to Simply Me Photography (Lori Lokken) to use my name and photographs in all forms and media for advertising, trade, and any other lawful purposes.
